Steps to a Stepparent Adoption Case in Nebraska


01 Preparing to File

Before a stepparent can adopt their stepchild, the child’s non-custodial parent will need to consent to the adoption and relinquish his or her parental rights. Consent to the adoption must also be obtained from any court that has exercised jurisdiction over the child, such as a court that has issued a custody order or child support order. If the child is over the age of 14 years, the child must also consent to the adoption.

02 Petition for Adoption

We will guide you through each step of the process as we draft and file the required forms, such as the petition for adoption and necessary notices.

03 Background Checks

Before the hearing on the adoption, the adopting parent must undergo a criminal background check, adult and child abuse and neglect registry check, sex offender registry check, and credit check.

04 Hearing

At the hearing, the court will issue its decision regarding the proposed adoption.

05 Post Hearing Matters

If consent was required from other courts, those courts will be notified that the adoption was finalized and any order for child support will be terminated. Supernaw Law can also help the parents obtain new birth certificates.
